eBay Buyers Don't Have Control over Returning the Wrong Item? - EcommerceBytes

Summary

Dear Ina,

Once or twice per year eBay hits the press boasting of their seller protection. Do they do this for Wall Street or is just an attempt to convince sellers that they are doing something about buyer fraud? Many sellers who post on EcommerceBytes say that there is no seller protection, that it is all lip service. I for one agree.

I recently sold an item that was in beautiful condition, no defects whatsoever. After receipt, the buyer opened an Item Not As Described case and attached a photo of a similar item stamped with a large DEFECTIVE stamp on the inside of the item. I knew that I did not sell that item to the buyer but I had no choice but to take it back.

When I received the garment back, I immediately compared the outside tag of the item that I sent to buyer to the tag of the item that I received back. They were not the same tags. I am attaching photos of those tags so that you can see them but for privacy's sake please do not publish those tags. I don't need eBay tracking me down and punishing me.

I spoke to an eBay representative and he told me that he would help me with this. He had me open a case and asked me to provide a photo of the tag that was sent and the tag that I received back. I was taken aback with eBay's response as they closed the case in the buyer's favor. The verbiage from eBay read:

We reviewed this case and decided to issue the buyer a full refund.

We understand that you received your item in a different condition than when you shipped it, but unfortunately we couldn't determine that this was caused by the buyer, or that this was something in the buyer's control.

A refund of US $XX.XX was issued on XXX XX, 2022 to the buyer. The refund includes the purchase price plus original shipping.

Could not determine that this was caused by the buyer? Was something in the buyer's control? Did a fairy swoop in and change the tag on its way back to me?

If this is eBay's thinking, this supports what many sellers on EcommerceBytes have said about eBay's seller protection. There is no seller protection on eBay. Needless to say, I won't be filing an appeal so that eBay slaps me with a $20 fee.

Please do not use my name. We all know what eBay is capable of when one speaks out.
